This is necessary for the operation of the website, as well as for the establishment, implementation and processing of the existing user contract with the web host and is also possible without your consent.

In addition, data is passed on if we are entitled or obliged to pass on data on the basis of legal regulations and/or official or court orders. In particular, this may involve providing information for law enforcement, security purposes or the enforcement of intellectual property rights.

If your data is passed on to service providers to the required extent, they will only have access to your personal data to the extent necessary to fulfill their tasks. As far as no personal reference is required to fulfill the purposes pursued, your data will be pseudonymized or anonymized for further data processing. The service providers we use are obliged to treat your personal data in accordance with the applicable data protection laws, in particular the GDPR.

Currently, your personal data is transferred to the following categories of service providers/recipients depending on your use of our website.

9. Rights of data subjects
If you are a data subject within the meaning of Art. 4 No. 1 GDPR, you have the following rights with regard to the processing of your personal data in accordance with the GDPR. The legal text of the rights listed below can be found at https://www.bfdi.bund.de/SharedDocs/Publikationen/Infobroschueren/INFO6.html.

Right to confirmation and information
Under the conditions of Article 15 GDPR, you have the right to request confirmation as to whether personal data relating to you are processed and to obtain, at any time and free of charge, information from the controller about the personal data relating to you stored and a copy of this information.

Right to correction
Under the conditions of Art. 16 GDPR, you have the right to demand the immediate correction of incorrect personal data concerning you. You also have the right, taking into account the purposes of the processing, to request the completion of incomplete personal data – also by means of a supplementary declaration.

Right to cancellation

10. Single Sign-on
Single sign-on” or “single sign-on login or authentication” refers to procedures that allow users to log in to a single sign-on provider (e.g., a social network), including our career portal, using a user account. The prerequisite for single sign-on authentication is that users are registered with the respective single sign-on provider and enter the required access data in the online form provided for this purpose, or are already registered with the single sign-on provider and confirm the single sign-on registration via button.

Authentication is carried out directly with the respective single sign-on provider. In the course of such authentication, we receive a user ID with the information that the user is logged in under this user ID at the respective single sign-on provider and an ID that cannot be used by us for other purposes (so-called “user handle”). Whether additional data is transmitted to us depends solely on the single sign-on procedure used, on the data releases selected during authentication and also on which data users have released in the privacy or other settings of the user account with the single sign-on provider. Depending on the single sign-on provider and the user’s choice, this can be different data, usually the e-mail address and the user name. The password entered as part of the single sign-on procedure with the single sign-on provider is neither visible to us nor is it stored by us.

Users are asked to note that their details stored with us may be automatically synchronized with their user account with the single sign-on provider, but that this is not always possible or will actually occur. If, for example, users’ e-mail addresses change, they must change them manually in their user account with us.

We may use single sign-on login, if agreed with users, as part of or prior to registration, where users have been asked to do so, process it as part of consent, and otherwise use it based on the legitimate interests of us and the interests of users in an effective and secure login system.

Should users ever decide that they no longer wish to use the link of their user account with the single sign-on provider for the single sign-on procedure, they must remove this link within their user account with the single sign-on provider. If users wish to delete their data from us, they must cancel their registration with us.

Types of data processed: inventory data (e.g. names, addresses), contact data (e.g. e-mail, telephone numbers).
Affected persons: Users (e.g. website visitors, users of online services).
Purposes of processing: service, registration procedure.
Legal basis: consent (Art. 6 para. 1 p. 1 lit. a DSGVO), contract performance and pre-contractual requests (Art. 6 para. 1 p. 1 lit. b. DSGVO), legitimate interests (Art. 6 para. 1 p. 1 lit. f. DSGVO).
Services used and service providers: Xing (XING AG, Dammtorstraße 29-32, 20354 Hamburg, Germany) – Privacy Policy/ Opt-Out: https://privacy.xing.com/de/datenschutzerklaerung.

Some services of this website use cookies to provide you with convenient online services with multiple features and to be able to verify your eligibility to use the services.

Cookies are text files that contain information to identify returning visitors only for the duration of their visit to the website. Cookies are stored on your computer’s hard drive; they do no damage.

The cookies of the website contain personal data. Cookies save you from having to enter data repeatedly; they facilitate the transmission of specific content and help fme identify which elements of the website seem to be particularly interesting to our visitors. This enables fme to tailor the contents of the website to your needs.

12. Use of consentmanager.de CMP

The CMP solution used by us consentmanager.de is TTDSG-, DSGVO- and ePrivacy-conform.

13. Google Analytics
This website uses functions of the web analysis service Google Analytics. Provider of the web analysis service is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
Google Analytics uses “cookies”. These are small text files that your web browser stores on your end device and enable an analysis of website usage. Information generated by cookies about your use of our website is transmitted to a Google server and stored there. As a rule, the servers are located in the USA.
Google Analytics cookies are set on the basis of Art. 6 para. 1 lit. f GDPR. As the operator of this website, we have a legitimate interest in analysing user behaviour in order to optimise our website and, where applicable, our advertising.
We use Google Analytics in conjunction with IP anonymization. It ensures that Google shortens your IP address within member states of the European Union or in other signatory states to the Agreement on the European Economic Area prior to transmission to the USA. There may be exceptional cases in which Google transmits the full IP address to a server in the USA and shortens it there. On our behalf, Google will use this information to evaluate your use of the website, to create reports on website activity and to provide us with other services relating to website and Internet use. The IP address transmitted by Google Analytics is not merged with other Google data.
The setting of cookies by your web browser is preventable. However, some functions of our website may be restricted by this. You may also opt-out of the collection of information about your use of the website, including your IP address and subsequent processing by Google. This is possible by downloading and installing the browser plugin available via the following link: https://tools.google.com/dlpage/gaoptout?hl=en.
Details on how Google Analytics handles user data can be found in Google’s privacy policy: https://support.google.com/analytics/answer/6004245?hl=en.
To fully comply with legal data protection requirements, we have concluded an order processing agreement with Google.
Our website uses the “demographic features” function of Google Analytics. It can be used to create reports that contain information on the age, gender and interests of site visitors. This data comes from interest-related advertising by Google and from visitor data from third-party providers. It is not possible to assign the data to a specific person. You can deactivate this function at any time. You can do this through the ad settings in your Google Account or by generally prohibiting Google Analytics from collecting your information, as explained in the “Opt-out of data collection” section.
Alternatively, you can prevent collection by Google Analytics by setting an “opt-out cookie” by clicking here. If you delete the cookies in your browser, you must then click this link again.
You can find Google’s privacy policy at: https://policies.google.com/privacy/partners?hl=en
14. Google Tag Manager
This website uses the Google Tag Manager. This service helps to manage web page tags via a user interface. Google Tool Manager only implements tags. This means: no cookies are used, and no personal data is collected. The Google Tool Manager triggers other tags, which in turn may collect data. However, Google Tag Manager does not access this data. If deactivation has been effected on the domain or cookie level, it will remain effective for all tracking tags as long as they are implemented by means of the Google Tag Manager.

We process data with the help of HubSpot Analytics for the purpose of optimizing our website and for marketing purposes based on your consent according to Art. 6 paragraph 1 lit. a. DSGVO.
The specific storage period of the processed data cannot be controlled by us, but it is determined by HubSpot, Inc. Further information can be found in the HubSpot API privacy policy: https://legal.HubSpot.com/privacy-policy.

c. HubSpot Forms

The information generated by the cookie about your use of this website is stored on a server in the USA. The IP address is anonymized immediately after the processing of the data and prior to its storage. You can prevent the installation of cookies by means of a particular setting of your browser software; however, we would like to point out that in this case, you may not be able to use all functions of this website in full. You can object to the collection and use of the data with effect for the future by clicking on the link “Click here to opt-out” to set an opt-out cookie in your browser: https://www.quantcast.com/opt-out/. If you delete all cookies on your computer, you must set the opt-out cookie again..
17. Disqus Comment System
This site uses DISQUS, an interactive commenting system that allows the user to comment on all web sites that use DISQUS as a commenting system with just one login. In addition, users can log in via existing accounts on Facebook (via Facebook Connect), Twitter, Yahoo and OpenID. You can also leave a comment without registering and log in (as a “guest”). The DISQUS technology is provided by company DISQUS, Inc., 301 Howard St, Floor 3, San Francisco, California-94105, USA. The collation of the data in question are subject to DISQUS’s terms of use and privacy policy, which can be found at: https://help.disqus.com/customer/portal/articles/466259-privacy-policy and https://help.disqus.com/customer/portal/articles/466260-terms-of-service. If you sign in via your Facebook, Twitter, Yahoo or OpenID account, these providers may also collect, store and use data. Details can be found in the privacy policy of the respective providers.

DISQUS will provide fme with the users’ e-mail addresses and the IP addresses, which are used with a comment. fme will only use such information for the purpose of contacting you in connection with your use of DISQUS, for example, in case of queries regarding your user comments. We will, of course, not disclose any of such data to any third party.

fme reserves the right to delete inappropriate comments or comment spam.

18. Social Plug-ins
This website has integrated social media / social sharing features. However, fme has decided to use the Shariff script to protect website users.

fme does not collect any personal data by means of social plugins or subject to the fact that a user uses a social plugin. In order to prevent data from being transmitted to service providers in the USA without your knowledge, fme uses the so-called Shariff solution, which ensures that no personal data is passed on to the providers of the individual social plugins when you merely visit this website. Only if you click on one of the social plugins, data may be transmitted to the service provider and stored there.

More information about the Shariff solution can be found on the site of the provider of the service, i.e. Heise Medien GmbH & Co. KG: http://m.heise.de/ct/artikel/Shariff-Social-Media-Buttons-mit-Datenschutz-2467514.html

19. General information on fme's presence in social networks
In order to present our company in the best possible way, to communicate with you as a user, customer or interested party and to inform you about the services we offer, we use social networks.
You find us on the following platforms/social networks:

  • Facebook
  • Instagram
  • LinkedIn
  • XING
  • Youtube
  • Twitter

When social networks are used, data is also processed outside the European Union (EU) and the European Economic Area (EEA). An equivalent level of data protection to the one in the EU cannot be guaranteed in all countries outside the EU. This may entail risks for you as a user if the transferred data is processed in so-called third countries with an inadequate level of data protection and privacy standards.

This makes it more difficult to enforce the user rights we are familiar with. In addition, the provider in the third country might not process your data in your interest. Certain providers in the USA have certified themselves under the so-called Privacy Shield Agreement – an agreement on data protection between the USA and the EU. Such providers are obliged to comply with EU data protection standards.

The processing purposes of the social networks usually differ from ours. For example, the data collected from you in social networks is usually processed for the purposes of market research, advertising and creating user profiles for personalised advertising (e.g. Facebook, Google, Instagram, etc.).

In order to achieve this, cookies are used, which record user behavior and enable the user to create a profile. In the case of Facebook, a user profile is also created for persons who do not have a registered account on Facebook. You can find a list of the processing purposes for the user data provided as part of the data protection and privacy notices of the respective providers. By making the appropriate settings in your user account, you can restrict the creation of your profile to a certain extent. For the exact procedure, please read the respective provider’s data protection information.

Facebook Fanpage

When you visit our Facebook page, Facebook collects, among other things, your IP address and other information that is available on your PC in the form of cookies. Such information is used to provide us, as operators of Facebook pages, with statistical information about the use of the Facebook page. Facebook provides further information on this under the following link: http://de-de.facebook.com/help/pages/insights.

It is not possible for us to draw any conclusions about individual users by means of the statistical information which is transmitted to us. We only use such information to respond to the interests of our users and to continuously improve and ensure the quality of our online presence.

We only collect your data via our fan page in order to make it possible for you to communicate with us and interact with us. This collection generally includes your name, news content, commentaries and the profile information you provide voluntarily and “publicly”.

The processing of your personal data for the above-mentioned purposes is based on our legitimate business and communicative interest in providing a channel for information and communication pursuant to Art. 6 Para. 1 lit. f DSGVO [EU General Data Protection Regulation]. If you as a user have given your consent to data processing to the respective provider of the social network, the legal basis for processing extends to Art. 6 Para. 1 lit. a, Art. 7 DSGVO.

Due to the fact that the actual data processing is carried out by the provider of the social network, only this provider has completely free access to your data, which we do not have. Therefore only the provider can directly take and implement appropriate measures to fulfill your user rights (request for information, request for deletion, objection, etc.). An assertion of pertaining rights will thus be most effective if directed directly against the respective provider.

Should you nevertheless require help in this matter, please do not hesitate to contact us.
